1. Introduction

Stickmag.com (“we,” “us,” or “our”) respects the intellectual property rights of others and is committed to complying with the provisions of the Digital Millennium Copyright Act (DMCA). This policy outlines our procedure for addressing claims of copyright infringement, including how to submit a takedown notice and how to file a counter-notification.

2. How to File a Notification of Copyright Infringement

If you are a copyright owner or an authorized agent thereof and believe that any content hosted on Stickmag.com infringes upon your copyright, you may submit a written notification of claimed infringement to our Designated Agent.

To be effective, your DMCA notice must be a written communication that includes the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notification, please provide a representative list of such works.
  3. Identification of the infringing material and information reasonably sufficient to permit us to locate it (e.g., the specific URL of the page where the material is located).
  4. Your contact information, including your name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a complete and valid infringement notice, we will act expeditiously to remove or disable access to the allegedly infringing material and notify the user who posted the content.

3. How to File a Counter-Notification

If you believe that your content was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Designated Agent.

Your counter-notification must be a written communication that includes the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
  4. Your name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Stickmag.com may be found), and that you will accept service of process from the person who provided the original infringement notification or their agent.

Upon receipt of a valid counter-notification, we will promptly forward a copy to the original complaining party. We may then replace the removed material or restore access to it within 10 to 14 business days, unless the original complainant notifies us that they have filed a court action seeking an order to restrain you from engaging in the infringing activity.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers of copyright.
